    Mumbai Court Issues Notice to Mamata Banerjee for Insulting National Anthem
     

    Digital Desk: Mazgaon Magistrate Court in Mumbai had ordered West Bengal Chief Minister Mamata Banerjee to appear before the court on March 2 after a case was filed against her for allegedly insulting the national anthem during one of her visits to the city on December 1, 2021.

    Advocate Vivekanand Gupta, a BJP functionary, has filed a complaint against her under Section 3 of the 1971 Prevention of Insult to National Honours Act.

    Gupta’s complaint to the court stated, “When the national anthem started Mamata Banerjee was sitting thus insulting the national anthem. Later, she rose up and sang two verses before abruptly ceasing to sing the anthem. Video of which has viral on social media.”

    “Banerjee demonstrated total disdain towards the national anthem. She even fled the venue after abruptly interrupting the anthem.” the complaint added.

    “Though the accused is the Chief Minister of West Bengal, she did not discharge her official obligations.” Gupta claimed in court.

    While issuing the process, Magistrate PI Mokashi stated, “The accused sung the national anthem but abruptly stopped and left the venue, as evidenced by the complaint, the complainant’s verification statement, the video clip on the DVD, and video clips on YouTube links, prima facie proving that the accused has committed a punishable offence under Section 3 of the Prevention of Insults to National Honour Act, 1971. Despite her residence outside the region of jurisdiction, there is no cause to postpone the process against the accused under Section 202 of the Code of Criminal Procedure. The complainant’s prima-facie proof is adequate to issue the procedure against the accused.”
