Pithani’s lawyers argued that section 27A was incorrectly applied because only a small amount of contraband was confiscated from him.
Digital Desk: The late actor Sushant Singh Rajput’s flatmate Siddharth Pithani was granted bail by the Bombay High Court on Monday in a drugs case filed by the Narcotics Control Bureau (NCB) in 2020 following the actor’s death.
The NCB charged Pithani under Section 27A of the Narcotic Drugs and Psychotropic Substances Act. After getting his default bail request refused by the special NDPS court, Pithani went to the high court.
Pithani was granted bail by Justice Bharati H. Dangre’s single-judge panel after presenting a 50,000 rupee personal bond and two sureties.
Pithani’s lawyers argued that section 27A was incorrectly applied because only a small amount of contraband was confiscated from him. Additionally, the lawyer stated that the statements given by two co-accused, cook Dipesh Sawant and Rajput’s manager Samuel Miranda, were not acceptable as evidence of Pithani’s arrest. Pithani claimed in his appeal that there was no proof of his participation in the trafficking of illegal drugs.
However, special public prosecutor Shreeram Shirsat claimed on behalf of the NCB that recordings on Pithani’s phone and laptop and bank transactions made through Rajput’s accounts could be connected to the acquisition of illegal goods.
Before this, the special court had denied Pithani’s request for regular bail, saying that he was not eligible for release at that moment. It had provided him with interim relief, allowing him to attend his wedding last June.
