Probe agencies must have a 'Delicate Balance' between search, seizure, powers and privacy rights: Chief Justice

Digital desk: Chief Justice of India (CJI) D.Y. Chandrachud stated on Monday that a "delicate balance" must be maintained between an individual's right to privacy and the search and seizure powers given to investigative agencies such as the CBI.

At the 20th D.P. Kohli Memorial Lecture, honoring the first director of the federal investigative agency, the CJI was giving the keynote presentation.
A fair and just society is built on the delicate balance that exists in the field of criminal justice between the right to privacy and the authority to search and seize, according to Justice Chandrachud.

He continued by saying that maintaining due process is essential for maintaining the balance. The CJI also objected to "unwarranted" confiscation of personal devices, stating that it was vital to balance the necessity for investigation with the right to privacy of individuals.

Additionally, he urged the investigating agencies to "pick their battles," emphasizing that instead of spreading out too thinly in various cases, they should concentrate on crimes that threaten the security and economic health of the country and public order.

According to Justice Chandrachud, the Central Bureau of Investigation (CBI) and other investigative agencies need to improve their capacity to address the "unprecedented pace" at which crime is changing, in addition to utilizing artificial intelligence (AI) tools.

He said law enforcement agencies like the CBI are faced with new and complex challenges that call for creative solutions as our world grows more interconnected through the development of digital technologies. These challenges range from cybercrime and digital fraud to the exploitation of emerging technologies for illicit purposes.
