Digital Desk: Union Minister for Communications, Electronics, and Information Technology Ashwini Vaishnaw tabled the Digital Personal Data Protection Bill, 2023 in the Lok Sabha on Thursday, despite considerable resistance. The modified bill includes a penalty of up to Rs 250 crores for each data breach.
The Bill was introduced in parliament to prevent data misuse and exploitation.
It grants the government specific exemptions to investigate or determine the financial information, assets, and liabilities of any individual who has defaulted in payment due on account of a loan or advance obtained from a financial institution.
It should be noted that the Bill is being introduced six years after the Supreme Court of India defined the right to privacy to be a fundamental right.
It permits data processing without user agreement in specific instances, such as medical emergencies, natural catastrophes, court decrees, and government agency mandates.
The schedule allows for a maximum fine of Rs 250 crore and a minimum fine of Rs 50 crore to be imposed on organisations that violate the criteria.
The Bill's provisions allow the Centre to limit access to content in the public's interest upon receiving a written reference from the board. Additionally, the law also establishes the government's or private firms' rigorous responsibility.
