Digital Desk: One thing AI has taught us in recent years is that what we see and hear might not be true to our senses. Checking the legitimacy of any content is very important in this era of AI-generated content. AI started its inclination among the Indian audience in 2023 with ChatGPT as the most popular AI-based tool.
By the end of 2023, AI started to emerge that can manipulate photos, create AI-based videos, and also generate and mimic voices of other prominent figures according to the inputs of the user, this was the start of deepfake technology. Deepfakes can, with such precision, manipulate any content that no individual can distinguish whether it is real or fake.
The first case of deepfake that can be recalled in India was of Rashmika Mandanna with her AI-generated video going viral on all social media platforms, as well as various other cases of political figures have emerged in recent years. To tackle such exploits India lacks a legal framework that directly addresses and protects its citizens from these AI-generated content or deepfakes and violations of AI technology.
However, there are some laws that can be used to address these misuses. For instance, Section 66E of the Information Technology Act, of 2000 is applicable in cases of deepfake crimes that involve capture, publication, or transmission of a person’s image in mass media. Sections 67,
67A, and 67B can be used to prosecute individuals for publishing or transmitting deepfakes that are obscene or contain any sexually explicit acts.
The laws in India may not be strong compared to other countries to curb such problems but it is doing its part in protecting the citizens of its country. As it is the problem of the new era, it will take time to make laws regarding these matters. During these situations, the best thing for the victim to do is preserve the evidence like screenshots URLs, and timestamps of the manipulated content, and report it to the cybercrime cell.
