Digital Desk: A Delhi High Court has stayed a notice issued to a company by the Health Department for allegedly indulging indirect advertisement of tobacco products in violation of the law and hiring a famous Bollywood actor to drag youngsters into tobacco habits.
It alleged that through the newspaper ad, the company indulged in a surrogate advertisement of ‘Vimal gutka’ and that the brand name ‘Vimal’ is registered for chewing tobacco, zarda, gutka, and khaini.
Ajay Devgan is one of the most popular and highly paid actors in the Bollywood industry.
His commercial Vimal pan masala and the ad slogan ‘Bolo Zuban Kesari’ is popular among the ‘zuban kesaris’ and also the fans sometimes move out to ‘paint the city’ in the saffron.

But once Ajay Devgan was asked to stop promoting Vimal Pan Masala by one of his fan? but why?
A 40-year-old man named Nanakram, who claims to be a fervid fan of the megastar claimed that he has been chewing ‘Vimal pan masala for a long time. He also said that tobacco has caused an adverse effect on his life and he is suffering from cancer.
Nanakram, who is from Rajasthan, made an appeal to Ajay Devgan to stop endorsing tobacco products in the interest of society. He even circulated nearly 1000 pamphlets explaining how much he and his family chews tobacco. The pamphlets have been posted on the walls in Sanganer, Jagatpura, and nearby areas of the city.
In the pamphlet, Nanakram also urged that actors should not promote products like liquor, cigarette, and tobacco. He is a father of two children and runs a tea stall in the Sanganer town of Jaipur. Due to cancer, he cannot speak now.
Interestingly, the additional District judge Rajinder Singh said that even though the COTPA Act prohibits the display of tobacco ads and the sale of tobacco products, there is no specific prohibition regarding surrogate advertisement.
The judge also mentioned that if the advertisement for the product is stopped during the pendency of the suit, it will cause a loss of revenue as well as goodwill which will be irreparable.
Thus allowing the company to carry out its ad campaign.
