Digital Desk: Assam is set to become the third Indian state, following Uttarakhand and Gujarat, to implement the Uniform Civil Code (UCC), as announced by Chief Minister Himanta Biswa Sarma.
He emphasized that the Assam model would have distinct features, addressing issues like child marriage and polygamy while incorporating Assam-centric innovations. Notably, tribal communities in Assam will be exempted from the UCC.
The UCC entails a single set of laws applicable to all religious communities concerning aspects like marriage, divorce, inheritance, adoption, and maintenance.
Despite India having a uniform criminal code, the absence of a uniform civil law has been a longstanding debate. Article 44 of the Indian Constitution advocates for a Uniform Civil Code, emphasizing the state's duty to ensure its implementation across the nation.
In December 2023, Uttarakhand took a significant step forward by approving decisions made by an expert panel drafting the UCC for the state. Chief Minister Sarma's announcement positions Assam to follow suit, awaiting the implementation by Uttarakhand and Gujarat. Sarma highlighted that the Assam-specific bill, set to be introduced in the state assembly this year, would reflect the region's unique circumstances.
Prime Minister Narendra Modi has consistently stressed the significance of a single legal framework, asserting that the country cannot function effectively with dual laws.
