Supreme Court stays Rahul Gandhi's conviction in Modi surname defamation case

Digital Desk: Rahul Gandhi got relief from the Supreme Court on Friday when the high court stayed his conviction in the defamation case involving his statement about the "Modi surname," clearing the way for him to contest elections. Rahul Gandhi has appealed the Gujarat High Court's decision to hold his conviction on July 7 after it rejected to do so.

Abhishek Singhvi, a renowned lawyer, has represented Rahul Gandhi. The Congress leader's lawyer, Singhvi, said, "Complainant Purnesh Modi’s original surname is not 'Modi' and he adopted this surname later. No one Gandhi mentioned in his speech has filed a lawsuit. With 13 crore residents, this is a small group with little uniformity or homogeneity. Only BJP officeholders who have filed cases are considered the aggrieved parties in this community.

"For 8 years, my client will remain silent. He is not a criminal. Several cases brought by BJP karyakartas against him resulted in no convictions and no penalty. The lower court judge described it as a severe offence and imposed a 2-year sentence. This was not a case of rape, murder, or kidnapping, " Sighvi countered.

According to senior lawyer Mahesh, who is representing complainant Purnesh Modi, every word of Rahul Gandhi's speech was over 50 minutes long, and the EC's record contains a plethora of proof and a tape of the speech. Jethmalani claims that Rahul Gandhi intentionally slandered an entire class. According to Jethmalani, "His aim was to insult every person of Modi surname because PM's surname is Modi."

Rahul Gandhi has repeatedly refused to apologise for his remark against the Modi surname that resulted in his removal from the House of Representatives, but he has requested the Supreme Court stay his conviction in the criminal defamation case related to that remarks because he believes he is not guilty.

The Congress leader was disqualified as a Member of Parliament on March 24 after being found guilty and given a two-year imprisonment in Gujarat for criminal defamation charges stemming from remarks he made against the Modi family. His request for a stay of execution had been denied by the supreme court, which noted that "purity in politics" was urgently needed.
