A Special Investigation Team was assigned to investigate the Lakhimpur Kheri case which claimed the lives of eight people on October 3 including four farmers. The report presented by the SIT stated that it was not a fortuitous killing but a conspiracy and now all the 14 prime accused arrested in connection to the incident will face charges of murder.
According to the reports, the SIT investigating the October 3rd Lakhimpur Kheri violence has applied to the Chief Judicial Magistrate (CJM) Vidhyaram Diwakar to include new sections against the 14 accused to make their offense punishable under attempt to murder charges.
the SIT investigating officer, applied last week in the CJM's court for adding new sections in the warrant, replacing sections 279, 338, and 304A of the IPC.
In his application to the CJM the SIT in charge stated that the incident was pre-planned and was a cold-blooded murder and not of negligence or callousness.
It must be noted that Union Minister of State for Home Affairs, Ajay Mishra has conceded that the vehicle that ran over people was indeed registered in his name. However, he denied reports that he and his son, accused Ashish Mishra were on the spot when the incident occurred.

Ashish Mishra has claimed that he was attending a wrestling event at the village when the incident occurred while farmers say the Minister’s son was behind the wheel of one of the vehicles that hit a group of farm protesters that day. Four farmers were killed in the incident and four others in the violence that followed.

Though, after all the attempts to defend himself, the SIT claimed all 14 accused to be guilty and to face murder charges according to the IPC.
The investigating officer has requested to add Sections 307 (murder attempt), 326 (Voluntarily causing grievous hurt by dangerous weapons or means), 34 (Acts done by several persons in furtherance of common intention) of the Indian Penal Code after replacing sections 279 (Rash driving or riding on a public way), 338 (Whoever causes grievous hurt to any person by doing any act so rashly or negligently) and 304A (Causing death by negligence) of the IPC.
Besides charges of murder and conspiracy, the FIR has also listed various IPC sections related to rioting, dangerous driving, and death by negligence.
On the 3rd of October, eight people died in a violent incident in Lakhimpur.
Reportedly, a vehicle rammed upon the farmers and smashed them to death.
According to the locals the vehicle was carrying BJP workers and it intentionally rammed upon the farmers.
The SIT report has set a sense of insecurity and clouds of uncertainty hovering upon the functioning of BJP in the region.
