Assam: New guidelines issued for Implementing CAA 2019

These instructions, dated July 5, 2024, and signed by Partha Pratim Majumdar, are part of continuous efforts to effectively implement the Citizenship (Amendment) Act, 2019...

Digital Desk: The Special Director General of Police (Border) in Assam has been instructed on the implementation of the Citizenship (Amendment) Act, 2019. Under directives from Partha Pratim Majumdar, Secretary to the Government of Assam, Home and Political Department, new protocols have been established for managing cases related to the Act.

According to the Citizenship (Amendment) Act, 2019, and Rules issued by the Ministry of Home Affairs (Notification No. G.S.R. 172 (E) dated March 11, 2024), individuals belonging to Hindu, Sikh, Buddhist, Jain, Parsi, or Christian communities who arrived in India from Afghanistan, Bangladesh, or Pakistan on or before December 31, 2014, are eligible for Indian citizenship.

As per the instructions, the border police are advised against referring cases of eligible individuals from these communities, who entered India before the specified date, directly to the Foreigners Tribunals. Instead, such individuals are encouraged to apply for citizenship through the portal https://indiancitizenshiponline.nic.in. Their applications will be evaluated by the Government of India based on individual circumstances, with a dedicated register maintained for this group.

However, it is clarified that this is not applicable individuals who entered Assam from Afghanistan, Bangladesh, or Pakistan after December 31, 2014, irrespective of their religion. Such cases will be promptly referred to the appropriate Foreigners Tribunal for further action upon identification.

These instructions, dated July 5, 2024, and signed by Partha Pratim Majumdar, are part of continuous efforts to effectively implement the Citizenship (Amendment) Act, 2019, and ensure the orderly processing of citizenship applications in accordance with the revised guidelines.
