Digital desk: In the Delhi excise policy case, Arvind Kejriwal vs Directorate of Enforcement Delhi Chief Minister (CM) Arvind Kejriwal decided to withdraw his plea before the Supreme Court against his arrest by the Enforcement Directorate (ED) after hours of speculation and an intense mention of episodes before the court on Friday morning.

Abhishek Manu Singhvi, Kejriwal's lawyer, informed the Supreme Court that he would present the matter before the Magistrate regarding his remand when the ED brings him before the Rouse Avenue court in Delhi.

"We are withdrawing the petition here as it is clashing with the remand. We will argue the remand and come back here . I will give a letter to the Registry (of Supreme Court regarding withdrawal)," Singhvi said. The Court allowed the request.

Kejriwal challenged his arrest by the ED on Thursday night in a writ petition filed at the supreme court. The Delhi High Court had earlier denied Kejriwal temporary protection from arrest.

The High Court's division bench, consisting of Justices Suresh Kumar Kait and Manoj Jain, had previously stated that it was not inclined to provide any kind of protection at this time. He was then taken into custody by the ED on Thursday following a late-night search of his home. He then move to the SC.

The issue was brought up Friday morning before Chief Justice of India DY Chandrachud, who stated that a special bench led by Justice Sanjiv Khanna would hear the case in courtroom 2.

After Justice Khanna agreed that the special bench, which also includes Justices MM Sundresh and Bela Trivedi, would hear the case after the main bench rose, Singhvi brought up the plea in courtroom 2. But Kejriwal then told the court that he was withdrawing his case.

The ED’s money laundering probe stems from a case registered by the Central Bureau of Investigation (CBI) on August 17, 2022 , in the context of purported anomalies in the Delhi Excise Policy for 2021–2022 is the basis for the ED’s money laundering investigation.

Lieutenant Governor VK Saxena filed a complaint on July 20, 2022, which led to the registration of the CBI case. AAP leaders, including former Deputy Chief Minister Manish Sisodia and other unidentified private individuals or businesses, are accused of hatching a criminal conspiracy during the policy-making process.

It has been stated that some of the "intentionally" left or created gaps in the policy were the cause of the conspiracy. These were purportedly intended to favor certain conspirators and licensees after the tender procedure.

The Delhi CM was called for questioning by the federal agency nine times previously. But each time, the Aam Aadmi Party (AAP) National Convenor decided not to respond to the summons.

He described the agency's summons as malevolent and claimed that the government was abusing it for political reasons. In connection with the case, Sisodia and AAP Rajya Sabha MP Sanjay Singh are already incarcerated.

K Kavitha was also taken into custody by the ED on March 15, 2024, and is currently incarcerated.
