Digital Desk: The Supreme Court issued a notice to the Centre and Attorney General R Venkataramani on Friday in response to two petitions by gay couples seeking that their marriage be recognized under the special marriage law.
A bench consisting of Chief Justice D Y Chandrachud and Justice Hima Kohli heard the brief submissions of senior advocate Mukul Rohatgi, before issuing notices on the pleas.
"Issue notice returnable in four weeks. The freedom to serve the central agency. Notice be also issued to the Attorney General for India," the bench said.
The petitions sought an order recognizing the marriage of two gay couples under the Special Marriage Act.
One plea was filed by gay couple Supriyo Chakraborty and Abhay Dang who live in Hyderabad.
They seek a direction for the freedom to marry a person of one's choice to be extended to LGBTQ (lesbian, gay, bisexual, transgender and Queer).
The petition stated that the non-recognition of same-sex marriages violates the right to equality and the right to life under Articles 14 and 21 of the Constitution.
In 2018, a five-judge Constitution bench of the Supreme Court unanimously decriminalized a part of the 158-year-old colonial law under Section 377 of the IPC, which criminalizes consensual unnatural sex.
