The Belgian Justice Department verified that India sent a formal extradition request regarding Choksi. The authorities decided to maintain confidentiality regarding the case details based on standard operational protocols.

Since 2nd January, 2018, Choksi has been on the run and continues his international fugitive status. The Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) submitted active warrants against him because he allegedly accepted Letters of Undertaking and Foreign Letters of Credit through fraudulent means during the period from 2014 through 2017. A total of ₹6,097.63 crore belonged to the bank based on the fraudulent actions that occurred. Additionally to Choksi, his nephew Nirav Modi stands as a primary defendant in this particular case.

Attorney Vijay Aggarwal expressed concern through legal representation that Choksi might face extradition to India following his arrest date. The defense stated that sending Choksi back to India citing both political motivations behind the case and inadequate healthcare provisions in India. The defense plans to base its extradition challenge on those two main reasons, according to Aggarwal.

Aggarwal further argued that societal status had not been conferred on Choksi to warrant declaring him a fugitive because the businessman continued cooperating with Indian investigative agencies. He stated that legal proceedings related to the case have been ongoing for several years and continue to be contested in court.
