Digital Desk: Silly Souls, the controversial Goa restaurant and bar located at a private home in Assagao, is controlled by Eightall Food and Beverages Limited Liability Partnership (LLP), a company run by Bharatiya Janata Party leader Smriti Irani's husband and children.
According to data collected through a right-to-information request, Dean D'Gama, who is Anthony D'Gama's legal representative, and the business entered into a lease agreement prior to the State Directorate of Food and Drugs Administration issuing a food licence.
Irani had earlier refuted any claims that she and her daughter were connected to the Silly Souls Cafe and Bar in House 452, Bouta Waddo, Assagao, Goa.
As per documents provided in response to an RTI, Dean D'Gama, Anthony D'Gama's legal counsel, and Eightall Food and Beverages signed a leasing agreement on January 1, 2021, for a ten-year term, at a monthly rent of Rs. 50,000.
Seventy-five percent of Eightall Food and Beverages Limited Liability Partnership is owned by Smriti Irani's husband and family.
Since the Goa excise commissioner published a notice in July saying that the liquor licence of Silly Souls Cafe and Bar had been renewed unlawfully, Irani has been at the centre of the dispute. In contrast to Irani's statements, Zoish, his daughter, claimed ownership of the business in an interview.
After a site visit on June 26, 2021, the application—complete with the corporate board's resolutions—was approved.
The Food Safety and Standards Authority (FSSA) licence for Eightall Food and Beverages, with the number 10621001000195, was awarded by the Goa government's FDA directorate on July 23, 2021.
You can see from the restaurant's website on Zomato, the online meal ordering application, that this is the same FSSA licence number that Silly Souls Cafe and Bar uses.
The company's liquor licence was renewed in June 2022, but because D'Gama passed away on May 17, 2021, the renewal was unlawful. In order to obtain the liquor licence, "fraudulent and falsified documents were manufactured," according to Rodrigues.
It is to be noted that in a show cause notice dated 21 July, the excise department had said, "The licence was renewed last month, despite the licence holder having passed away on 17/05/2021."
In a ruling dated July 29, the Delhi High Court noted that neither Union Minister Smriti Irani nor her daughter had ever received a licence for the Silly Souls Cafe and Bar in Assagao, Goa.
"It is obvious from the records in the file that no licence was ever granted in the plaintiff's or her daughter's favour. The eatery is not owned by the plaintiff or her daughter. Additionally, the plaintiff has prima facie proven that neither she nor her daughter ever submitted a licence application, the court said.
