Digital Desk: Rashtriya Swayamsevak Sangh General Secretary Dattatreya Hosabale stated on Tuesday that the RSS agreed with the government's stance on same-sex marriage. "Marriage can only take place between people of opposite genders," he said.

The Centre filed an affidavit in the Supreme Court on Sunday opposing the legalization of same-sex marriage in the nation. The Centre stated in its affidavit that same-sex relationships and heterosexual relationships are obviously distinct classes that cannot be treated identically.

The Centre informed the top court that living together as partners by same-sex individuals, which is decriminalized now, is not comparable to the Indian family unit concept of a husband, a wife, and children born out of the union.

It further mentioned that statutory recognition of marriage limited to heterosexual in nature is the norm throughout history and is foundational to both the existence and continuance of the state. It stated that there is no violation of basic rights as a result of the non-recognition of same-sex marriages.

One of the petitions submitted to the Supreme Court sought a gender-neutral interpretation of the Special Marriage Act, 1954, in which a person is not discriminated against due to his sexual orientation.

The top court's five-judge Constitution bench ruled unanimously on September 6, 2018, that consensual sex between mature homosexuals or heterosexuals in a private place is not a crime, while overturning a section of British-era penal law that criminalized it on the grounds that it violated the constitutional rights to equality and dignity.
