Supreme Court has approved a “two-child norm” for public employment...

Digital Desk: The Supreme Court has approved a “two-child norm” for public employment where a person with more than two children will not be eligible for government jobs in Rajasthan. The rule is non-discriminatory, the judges said, hearing a petition challenging it.

A bench of Justices Surya Kant, Diapankar Dutta, and K V Vishwanathan said a somewhat similar provision, which was introduced as an eligibility condition to contest Panchayat elections. The SC in a recent order, declined to consider a plea by ex-serviceman Ramji Lal Jat against the Rajasthan High Court's judgment of October 12, 2022.

Ramji Lal Jat retired from service in 2017 and applied for a constable post in Rajasthan Police on 25th May 2018. His plea was rejected under Rule 24(4) of Rajasthan Police Subordinate Rules, 1989 following the norm set under the Rajasthan Various Service Amendment Rules 2001 says, “No candidate shall be eligible for appointment to the job who has more than two children on after June 1, 2002.”

Justice Kant-led bench said, “A somewhat similar provision, which was introduced as an eligibility condition to contest Panchayat Elections, has been upheld by the SC in the case of Javed and others vs state of Haryana in 2003. The court held that the classification which disqualifies candidates for having more than 2 living children, was non-discriminatory and intra-vires the Constitution, since the objective behind the provision was to promote family planning.”

The Justice bench dismissed Jat’s appeal saying the high court judgement did not warrant any interference.
