In a significant ruling, the Gauhati High Court has mandated that competent authorities in Assam must thoroughly review individual representations and supporting documents from persons alleged to be occupying reserved land without authorisation. This directive aims to ensure due process and fair consideration of each case before any punitive action is taken.

The court clarified that before taking any further action under the law, including potential eviction, officials must issue a 'speaking order' – a reasoned decision – determining the status of the individual concerning the land in question. This directive specifically applies to notices issued under Rule 18(2) of the Settlement Rules, which are framed within the broader Assam Land and Revenue Regulation, 1886, and pertain to various categories of reserved land.

Justice Manish Choudhury, presiding over the case, underscored the necessity of providing due opportunity to any noticee to present their case. The court observed that when an individual receives a notice alleging unauthorised occupation of land reserved under the Settlement Rules, they are entitled to submit a representation and any relevant documents. The authority is then obligated to give careful consideration to these submissions before reaching a conclusion.

This judgment emphasizes the importance of due process and fair hearing, ensuring that no action is taken against alleged encroachers on reserved lands without a proper, individual assessment of their claims and circumstances. It aims to safeguard individual rights while upholding the integrity of land regulations in the state.
