Digital Desk: A Supreme Court Constitution Bench is hearing an array of petitions seeking legal recognition of same-sex marriages in India.
Chief Justice of India DY Chandrachud chairs the bench, which also includes Justices Sanjay Kishan Kaul, S Ravindra Bhat, PS Narasimha, and Hima Kohli.
Yesterday, the court rejected the claim that legalising same-sex marriage would have an impact on the children of such couples, saying that lesbian and gay people are currently able to adopt children on their own.
The petitions sought legal recognition of same-sex marriages, saying that the freedom to marry the person of one's choice should be extended to LGBTQIA+ people as well.
The Central Government has objected to gay couples' appeals to the Supreme Court.
The Central government also stated in an affidavit filed before the Supreme Court that living together as partners and having sexual relationships by same sex individuals is not comparable to the Indian family unit concept, which involves biological man and biological woman with children born out of such wedlock.
The Centre has also filed an application seeking the Court to first rule on the petitions' maintainability.
Similar sentiments have been expressed by the Islamic religious organization Jamiat-Ulama-I-Hind, which has stated that conceptions such as same-sex marriage originate in western cultures with extreme atheistic worldviews and should not be forced on India.
The National Commission for the Protection of kid Rights (NCPCR) has rejected conferring adoption rights on same-sex couples, citing a study that suggests such a kid suffers social and psychological consequences.
However, the Delhi Commission for Protection of Child Rights (DCPCR) has backed the petitioners' argument, stating that same-sex couples should be granted adoption and succession rights.
