Digital desk: The Supreme Court refused to stay the appointments of Election Commissioners (ECs) Sukhbir Singh Sandhu and Gyanesh Kumar on Thursday, as it will raise chaos and result in uncertainity. The SC also said that perliament has enacted a law and prim facie court cannot order new selection of EC's by panel that doesn't included the chief justice of India (CJI).

In response to requests seeking a stay on the recent appointment of two poll commissioners under the Chief Election Commissioner and Other Election Commissioners Act, 2023, few days back the Center submitted an affidavit to the Supreme Court. 

The selection of Gyanesh Kumar and Sukhbir Singh Sandhu as election commissioners by a panel that does not include the Chief Justice of India was defended by the Center.

The affidavit claims that the Chief Election Commissioner and Other Election Commissioners (Appointment Conditions of Service and Terms of Office) Act, 2023, appropriately safeguards the high constitutional institution of the Election Commission and establishes a statutory mechanism for the Commission's operation that is far more democratic and participatory while upholding the standards established in the Supreme Court's ruling.

The Chief Justice of India's exclusion from the election commissioner selection panel is one of the act's noteworthy features. The Center, which was against the motions for a stay on the legislation, claimed that the Election Commission's independence and that of any other organization or authority were unrelated to and did not result from having a judge on the Selection Committee.

Furthermore, the Chief Justice of India-free panel that the Center uses to defend the two election commissioners' appointment procedure is absent.
