Digital Desk: Aam Aadmi Party (AAP) MP Raghav Chadha, has filed a suit in Delhi's Patiala House Court against the Rajya Sabha Secretariat after it denied him the allotment of a Type-VII bungalow.

Raghav Chadha argues in his petition that he could not have been evicted from the government home without proper process and that the letter terminating the allotment is unconstitutional.

The Rajya Sabha Secretariat cancelled the allocation of a Type-VII bungalow on Delhi's Pandara Road to the AAP's Raghav Chadha in March. He then filed Patiala House Courts against the RS Secretariat and obtained a stay order against dispossession.

The Patiala House Courts stated that Raghav "shall not be dispossessed without due process of law" in a decision dated April 19.

The Rajya Sabha Secretariat subsequently applied in response to Chadha's petition, alleging that the court could not have issued the April 19 order without first hearing the secretariat.

On June 1, the Rajya Sabha MP filed a reply to the application, arguing that he had been legitimately allotted the bungalow by the RS Chairman, that he had moved to the Type-VII bungalow after renovations, and that the allotment letter itself contained the circumstances/situations under which he could be asked to vacate the premises.

Chadha claims that the letter cancelling the allotment from the RS Secretariat is "arbitrary."

The next hearing on the matter is scheduled for July 10.

According to the Rajya Sabha Members Handbook, Chadha is eligible for Type-V accommodation as a first-time MP. Former Union Cabinet Ministers, former Governors or Chief Ministers, and previous Lok Sabha Speakers are eligible for Type-VII bungalows.
