New Delhi: In a major decision ahead of Diwali, the Supreme Court announced that there is no total ban on the use of firecrackers, only those fireworks that contain Barium salts are banned in the country.
A bench of justice M.R. Shah and A.S. Bopanna said that no authority could violate the direction issued by the court in the name of celebration. It further stated that celebration could not be at the cost of the other’s health.
The bench said, “There is no total ban on the firecrackers, only those firecrackers that contain Barium salts are prohibited as directed by the court, which are found to be injurious to health, affecting the health of the citizens, more particularly the senior citizens and the children.”

“Nobody is permitted to violate the right to health of others, guaranteed under Article 21 of the Constitution of India. Moreover, nobody can be permitted to play with the life of others more particularly the senior citizens and the children.” it added.
The Apex court said that failure to implement the ban on Firecrackers by the States and Union Territories would be viewed seriously.
Additionally, the Apex Court ordered all the States/Union Territories to make aware of the direction issued by the court through electronic/print media and local cable services on the manufacture, use and sale of banned firecrackers.
